Judge tells suspect to find an attorney for retrial.(Capital Region)

TROY - A man whose rape conviction was vacated in December by a midlevel appeals court, which also ordered a new trial, told a judge again Friday he still does not have an attorney.

Judge Patrick McGrath has called Robert Gorghan into court every two weeks over the past three months to ask him whether he has an attorney so pretrial motions can commence. Each time, including Friday, Gorghan said no.

"I think I have been more than patient with you," McGrath said. "A defendant has a right to pick a lawyer, but I also have to have control over my calendar."
